DVD-CCA holds its fire on Kaleidescape - September 17, 2007
The next meeting of DVD-CCA's Copy Protection Advisory Committee (CPAC) is scheduled for Sept. 19 in LA but don't expect much news.
The proposed amendment to the CSS license intended to close the "Kaleidescape loophole," is not on the agenda for the meeting, according to sources familiar with the program, so no vote will be held. So little is on the agenda, in fact, that some CPAC members are planning to skip the meeting altogether, suggesting the issue is losing its urgency withing the CSS licensing agency.
As a result, any further escalation of the legal dispute between DVD-CCA and the maker of home media servers is on hold for now.
When
last we tuned in, DVD-CCA's' lawyers had sent a letter to Kaleidescape CEO Michael Malcolm in response to Malcolm's
earlier missive to the organization threatening legal action if it went ahead with the proposed amendment. The DVD-CCA letter rejected Malcolm's claim that the group would face substantial antitrust liability if it went ahead, but said nothing about if and when the group might revisit the amendment.
The amendment would have reversed the results of a court ruling that held that Kaleidescape's home server design did not violate the CSS license governing the design of DVD drives. If passed, it would have effectively barred Kaleidescape from continuing to sell its servers.
