Cablevision ruling a major blow to media companies - August 4, 2008
Media Wonk hasn't had a chance to read the full opinion yet, but on it's face, the Second Circuit's order this morning
overturning the lower court's ruling in the Cablevision "network-DVR" case is a significant set-back for the media companies. In finding that Cablevision's system of user-directed remote recording does not directly infringe content owners' copyrights, the ruling opens the door to all sorts of other unlicensed remote storage services. More immediately, it undercuts what leverage the media companies might have had to cut a deal everyone might have been able to live with, such as permitting network-DVRs in exchange for an agreement to disable ad-skipping. Shoot too high and miss and you get nothing.
